What if you're not satisfied with an FOI decision?
The FOI Act provides two levels of review:
- First, you may request an internal review by applying in writing within 28 days of the date you were given notice of the decision. The official status or rank of the officer conducting the internal review is required to be at least as high as that of the officer who made the original decision. The agency must finalise this review within 28 days of receipt of your application.
- If you are still not satisfied, you can apply to the Information Commissioner for an independent external review. An application for an external review must generally be made within 28 days of the date you received notice of the results of the internal review.
