Labour hire and contracting
Purpose
The purpose of this submission is to inform on issues including, contracting and reasons for growth in contracting.
Issues covered
Labour hire arrangements involve a relationship between three parties in which the services of a worker are on-hired by a labour hire agency to a host company. Under these arrangements the on-hired worker may be an employee of the labour hire agency or a self employed contractor whose services are hired to the host employer.
In Australia, most labour hire employees are engaged as casual employees and there is no obligation on the part of the labour hire agency to guarantee continuity of engagements or to pay wages or any other benefits between engagements.
These include:
- contracting in Queensland
- labour hire
- disadvantaged working arrangements
- artificial work arrangements
- unsafe work practices
- options for consideration
Outcomes
The submission concludes with options for consideration on the contracting and labour hire industry:
- ways in which independent contracting can be pursued consistently across state and federal jurisdictions
- strategies to ensure independent contracting arrangements are legitimate
