While employees have rights in both the Anti-Discrimination Commission Queensland (ADCQ) and the Queensland Industrial Relations Commission (QIRC) , they should be aware of the consequences of lodging in both these jurisdictions.
For example, under section 153 of the Anti-Discrimination Act 1991 (PDF, 785 KB) a person who lodges a complaint with the ADCQ before lodging an application with the QIRC may be prevented from pursuing their claim in the QIRC. The overlap between these two jurisdictions may be complex and depend on the facts of your case. Therefore, it may be advisable to seek legal advice on this issue.
