Summary

Benito Calvi, carrying on the business of a restaurant at Paddington under the name of Albertos Restaurant and Pizzeria and being an employer under the Industrial Relations Act 1999 (PDF, 1.9 MB), was prosecuted for failing to pay an employee wages payable under the Order – Apprentices’ and Trainees’ Wages and Conditions (Excluding certain Queensland Government Entities) 2003 and the Hospitality Industry – Restaurant, Catering and Allied Establishments Award – South Eastern Division 2002. The employee was employed as an apprentice cook and was underpaid from 20 October 2006 to 30 March 2007 and no pro rata holiday pay was paid on termination of his employment. Calvi was convicted and fined $3,000 and ordered to pay $1,704.39 wages and $501.61 pro rata holiday pay.
