The Department of Justice and Attorney-General is a concurrence agency for existing and potential Major Hazard Facilities (MHF) under the Sustainable Planning Act 2009, and an advice agency for Large Dangerous Goods Locations (LDGLs) by invitation of the assessment manager as outlined in the Land Planning Schemes Advice Note (PDF, 72 kB).
The applicant must complete Part L: Major Hazard Facilities of the development application. The assessment manager arranges for the relevant documents to be provided to the Hazardous Industries Chemicals Branch (HICB) for assessment. HICB have 10 working days to request further information.
HICB will assess the supplied information, paying particular attention to possible major accidents with off-site impact. It is expected that the applicant will have assessed the risks of the proposal and have identified appropriate controls within their application documents. The team may challenge the applicant to demonstrate that the risk is acceptable.
Toxic exposure criteria are based on Emergency Response Planning Guideline (ERPG) values available from the American Industrial Hygiene Association Emergency Response Planning Committee.
HICB will respond within 30 days.
