Incident:

On 15 September 2004, a contractor for Acclaim Shopfitting Pty Ltd had four fingers on his left hand partially amputated as a result of contacting the unguarded blade of a spindle moulder.

Alleged breach:

s.24(1) and s.28(3) Workplace Health and Safety Act 1995

Summary of undertakings:

 

  • implementing a series of third party audits of the company occupational health and safety management system against the requirements of AS/NZS 4801
  • implementing recommendations resulting from the audits of the occupational health and safety management system
  • installing a dust reduction system within the workplace
  • conducting comprehensive workplace health and safety training for employees and contractors
  • developing and delivering a presentation to the Shopfitting Industry Association on the risks associated with spindle moulders and within the shopfitting industry generally
  • purchasing a state-of-the-art spindle moulder which includes a range of safety features to eliminate risks to workers when undertaking similar tasks, and
  • donating agreed amounts to the Queensland Cancer Fund, local schools and local sporting associations.

This undertaking has a total minimum expenditure of $146 396 (including recoverable departmental costs)..
