Incident:

On 10 February 2006 a freshly layed concrete block wall at a construction site collapsed due to strong winds, trapping two workers underneath it. The two workers suffered multiple fractures, contusions and lacerations.

Alleged breach:

s.24(1) and s.28(1) Workplace Health and Safety Act 1995

Summary of undertakings:

  • Develop and implement an occupational health and safety management system (OHSMS) consistent with AS/NZ 4804:2001.
  • Commit to a series of third party OHSMS audits to AS/NZ 4801 and to implement audit recommendations.
  • Promote and fund a training course in portable power tool safety aimed at new and young workers.
  • Organise, promote and fund a workplace health and safety golf day incorporating a half-day risk management seminar with participants vying for prizes valued at $2,000. Prizes to include contractor safety management plans and site safety evaluations and reports.
  • Donate $40,000 to the costs and construction generally of a house being built for 'Integrated Family and Youth Services Inc.'

The minimum agreed expenditure (including departmental recoverable costs) is $90,000.
