Incident:

The alleged contravention is “risk based” and in relation to work at heights procedures. There is no circumstance of aggravation alleged.

Alleged breach:

s.24(1) and s.30(1) Workplace Health and Safety Act 1995

Summary of undertakings:

  • Develop and implement nationally, a mandatory Permit to Work Policy.
  • Implement a series of occupational health and safety management systems (OHSMS) audits using AS/NZ 4801:2001.
  • Establish an information service to industry on working safely at height, including:
    • waiving its intellectual property in the Permit to Work Policy
    • making its procedures, training material and implementation actions freely available on request
    • providing guidance on request about the implementation, maintenance and monitoring of the Permit to Work Policy.
  • Run a safety awareness colouring competition in the Mackay-Nebo area in conjunction with local schools to produce a safety calendar. Schools may distribute calendars free or use to raise funds for school projects.
  • Third party monitoring of the terms of the undertaking.

The approximate value of the EU (including departmental recoverable costs) is $205,404.
