Incident:

On 22 April 2005 a worker of a labour hire company suffered injuries at Kador Engineering Pty Ltd when the side wall extension to a dump truck tipper tray that he was welding fell on his right leg causing a spiral fracture of the tibia.

Alleged breach:

s.24(1) and s.28(3) Workplace Health and Safety Act 1995

Summary of undertakings:

  • Implement a series of third party audits of the occupational health and safety management system (OHSMS), consistent with AS/NZ 4801:2001.
  • Implement the recommendations resulting from the audits of the OHSMS.
  • Provide Certificate III training in Process Manufacturing to 45 employees.
  • Provide funding for 150 apprentices to undertake a drug education course.
  • Publish a case study article in an industry magazine.

The approximate value of the EU (including departmental recoverable costs) is $106,535.
