Incident:

On 15 January 2005 a worker of a labour hire company suffered serious bodily injury at the host employer’s workplace when a large fuel tank that was being welded fell off a trestle stand onto the workers leg.

Alleged breach:

s.24(1) and s.28(3) Workplace Health and Safety Act 1995

Summary of undertakings:

 

  • Implement a series of third party audits of the occupational health and safety management system (OHSMS), consistent with AS/NZ 4801:2001.
  • Implement the recommendations resulting from the audits of the OHSMS.
  • Implement a staff and workshop development program.
  • Acquire new more effective magnetic clamps to replace existing mechanical clamps. Training in use of the new clamps is also proposed.  
  • Engage a consultant to investigate material handling and other workplace procedures aimed at minimising the movement of materials.
  • Engage expert speakers to participate in the conduct of a series of workshop conferences aimed at small businesses in the Sumner Park and Carole Park industrial complexes.

The approximate value of the EU (including departmental recoverable costs) is $125,815.
