Incident:

On 25 May 2006 an employee suffered crush injuries to his legs when struck by part of a forklift assembly which was in the process of being removed for repairs.

Alleged breach:

s.24(1) and s.28(1) Workplace Health and Safety Act 1995

Summary of undertakings:

  • Develop and implement an occupational health and safety management system (OHSMS) consistent with AS/NZ 4804:2001.
  • Engage an OHS consultant to conduct an initial third party audit of the new system within 12 months followed by a further two audits at 12 monthly intervals.  Implement all recommendations unless exempted.
  • Forward all audit reports to the General Manager WHSQ.
  • Establish additional Workplace Health and Safety Officers and train three employees as Workplace Health and Safety Auditors.
  • Offer free senior first aid training to all employees and their spouses.
  • Conduct an OHS seminar targeted at the local manufacturing industry.
  • Provide a donation for the procurement of Rapid Deployment Kits for the Queensland Ambulance Service.
  • Monitor the company's compliance with this undertaking through a series of third party compliance audits, with results reported to the General Manager WHSQ.

The minimum agreed expenditure (including departmental recoverable costs) is $103,000. This figure has been rounded down to the nearest $1,000.
