Incident:

On 20 December 2005 a labour hire employee working on the ice cream tub line suffered crush injuries to her forearm when one of her gloves got caught in a conveyer’s rollers.

Alleged breach:

s.24(1) and s.28(1) Workplace Health and Safety Act 1995

Summary of undertakings:

  • Initiate a third party assessment their occupational health and safety management system (OHSMS) against the requirements of AS/NZ 4801:2001.
  • Conduct third party OHSMS audits to AS/NZ 4801 and implement audit recommendations.
  • Establish and maintain a workplace OHS committee, including training for persons elected to the committee.
  • Provide training for 10 employees in first aid.
  • Provide workplace health and safety representative training for 10 employees.
  • Implement an employee assistance program.
  • Publish a case study article on the incident in a relevant trade journal or newspaper.  Text to be approved by the General Manager Workplace Health and Safety Queensland.
  • Engage a consultant to develop a food safety program for independent contractors within the food industry.
  • Sponsor Catholic Education Toowoomba to develop and implement a student safety training program.

The minimum agreed expenditure (including departmental recoverable costs) is $96,070.
