Incident:

On 24 July 2006 an employee suffered fracture injuries to his left shoulder as a result of his falling into an open stormwater pit at a civil construction work site.

Alleged breach:

s.24(1) and s.28(1) Workplace Health and Safety Act 1995

Summary of undertakings:

  • Conduct a series of third party audits of the company occupational health and safety management system against AS/NZS 4801:2001 and implement any subsequent audit recommendations.
  • Provide and maintain Site Hazard Isolation Kits to each Australian Turf Group work team and retained independent contractors.
  • Engage an occupational health and safety specialist to develop and deliver an extensive Employee and Contractor Induction Kit.
  • Engage an external consultant to develop and deliver a range of health and safety training to company employees and contractors.
  • A commitment to implement specific site safety planning and consultative arrangements throughout the company.
  • Make an ex gratia donation of an agreed amount to the Logan Hospital Fracture Clinic.
  • Develop and deliver a presentation at an industry forum on the management of health and safety risks in the turf and landscape industry.
  • Publish an industry journal article informing readers of the management of health and safety risks in the turf and landscape industry.

The minimum agreed expenditure (including departmental recoverable costs) is $108,171.
