Incident:

On 26 March 2006 a Capral employee was injured while attempting to clear scrap material that had become entangled in a press. The employee received lacerations and abrasions to the head area when the machine inadvertently activated.

Alleged breach:

s.24(1) and s.28(1) Workplace Health and Safety Act 1995

Summary of undertakings:

  • Auditing of the company's cccupational health and safety management system (OHSMS) against the requirements of AS/NZS 4801:2001 and implementation of recommendations resulting from these audits.
  • Auditing of the workplace against AS 4024: Safety of Machinery and the Plant Code of Practice.
  • Implement controls to elevate the company's standard of machine guarding to a level which exceeds legislative compliance.
  • Provide upgraded training and competency to persons using plant and machinery.
  • Train key managers, supervisors and team leaders in communication and effective safety leadership.
  • Host an industry seminar to discuss learning from the incident and process improvements in the risk management of machinery and isolation systems.
  • Creation and placement of 3 apprenticeships within the engineering field.
  • Sponsorship of the 'Screen Culture Exhibition' as part of a community festival.

The minimum agreed expenditure (including departmental recoverable costs) is $390,652.
