Incident:

On 6 June 2006 a prescribed occupation training course participant suffered soft tissue injuries to his left leg while exiting a bulldozer. The injured person was attending a training course being conducted by CSTC Pty Ltd.

Alleged breach:

s.24(1) and s.28(1) Workplace Health and Safety Act 1995

Summary of undertakings:

  • A commitment to implement and maintain an occupational health and safety management system (OHSMS) to AS/NZS 4801:2001.
  • Implementation of a series of third party audits of the OHSMS and implementation of recommendations resulting from these audits.  
  • Provide a range of specified training programs for staff, contractors, and small business on OHS related matters.
  • Provide a range of professional development training for staff, trainers and assessors.
  • Conduct a range of external activities such as audits and industry workshops that will deliver improved small business practices.
  • Provide resources for an industry organised fund raising day with benefits to be donated to the Mater Children’s Hospital and Men’s Prostate Cancer Research.
  • Donate an agreed amount to both the Mater Children’s Hospital and Men’s Prostate Cancer Research.

The minimum agreed expenditure (including departmental recoverable costs) is $221,885.
