Incident:

On the 12 June 2006 a worker was injured during the repair of a mulch placement truck. The workers left foot became caught in the hopper unit of the pumping truck when it was unexpectedly started during testing. The employee sustained a laceration, fractured heel and soft tissue loss over the heel pad to his left foot.

Alleged breach:

s.24(1) and s.28(1) Workplace Health and Safety Act 1995

Summary of undertakings:

 

  • Develop an occupational health and safety management system (OHSMS) compliant with AS/NZ 4801.
  • Develop a health and safety manual for its business.                                          
  • Undertake compliance audits of their OHSMS and implement the recommendations.
  • Publish their health and safety manual for reference by other bark blowing companies – both in Australia and internationally. 
  • Modify trucks to reduce the risk of falls from the top of the trucks.
  • Donate a piece of equipment to the Princess Alexandra Hospital.
  • Recover departmental costs.
  • Engage a consultant to oversee the injured worker’s rehabilitation and return to work.
  • Provide in-house and external training to injured worker to give him an alternate career path if complete rehabilitation not possible.

The minimum agreed expenditure (including departmental recoverable costs) is $70,688.
