Incident:

On 7 March 2007, a worker for SAW Formwork Pty Ltd was assisting with the erection of suspended floor formwork at a commercial construction site. During erection of the formwork the worker has fallen approximately 2.4 metres from the formwork deck to the ground below.

Alleged breach:

SAW Formwork Pty Ltd s.24(1) and s.28(1) of the Workplace Health and Safety Act 1995

Stephen Wollschlager s.24(1) and s.167 of the Workplace Health and Safety Act 1995

Summary of undertakings:

Activities SAW Formwork Pty Ltd and Stephen Wollschlager will undertake include:

  • implement an occupational health and safety (OHS) management system consistent with the requirements of AS/NZS 4801:2001 and conduct a series of third party audits of the system with reports to be provided to Workplace Health and Safety Queensland and audit recommendations to be implemented
  • develop and establish improved health and safety consultative arrangements within the workplace
  • implement the Lean Manufacturing program within the workplace
  • provide a range of specified health and safety training to company employees at all levels
  • engage an OHS professional for 12 months to advise and mentor staff on health and safety matters
  • develop and produce heath and safety promotional material for display and distribution throughout the workplace
  • engage an audio visual production company to produce a safety awareness video specific to the formwork industry
  • engage a research organisation to conduct attitudinal and perception surveys within the workplace to identify areas for health and safety improvement. Results of the survey will be included in a future industry journal article
  • establish a partnership with James Cook University School of Engineering by offering facilities for university research and development, and
  • donate an agreed amount to the Townsville General Hospital Orthopaedic Unit for the purchase of specified equipment.

This undertaking has a total minimum expenditure of $222,000 (including recoverable departmental costs).
