Incident:

On 17 October 2006, an employee of Veolia Environmental Services Pty Ltd suffered fracture injuries to his skull and lacerations to his facial area as a result of being struck on the head by the hydraulic binlifter of a waste collection vehicle.

Alleged breach:

A breach of s24(1) and 28(1) of the Workplace Health and Safety Act 1995, was alleged.

Summary of undertakings:

  • Conduct a series of third party audits of the company Occupational Health and Safety Management System against AS/NZS 4801:2001 and implement any subsequent audit recommendations.
  • Upgrade safety measures for the control of hydraulic binlifters on waste trucks.
  • Update safety procedures, instructions and manuals relating to the company’s waste collection business.
  • Appoint additional personnel with health and safety roles and functions.
  • Deliver a range of health and safety training to staff including WHSO, Incident Investigation, Hazard Identification and Risk Management, and Safety Leadership.
  • Promulgate information about the circumstances of the incident within the company, industry and to the vehicle manufacturer;

This undertaking has a total minimum expenditure of $304,536. (Including departmental costs).
