Incident:

On 17 October 2006 an employee of Shaw Transport Pty Ltd was injured while assisting Webster’s Transport P ty Ltd to move a machine press weighing 600kg.  Webster’s Transport had been contracted with Shaw Machinery Pty Ltd to transport the press from the premises of Pieters Signs and Sheet Metal at Ashmore to premises at Clontaf.  During the move the plant toppled over and fell onto the employee causing injury.

Alleged breach:

s.24(1) and s.28(1) Workplace Health and Safety Act 1995

Summary of undertakings:

  • Conduct a series of third party audits of the company occupational health and safety management system against AS/NZS 4801:2001 and implement any subsequent audit recommendations.
  • Gain National Heavy Vehicle Accreditation.
  • Undertake a specified audit and training program.
  • Provide training for managers, supervisors and staff on the principles of risk management.
  • Deliver presentation at an industry forum on the safe movement of fixed plant including a case study of this incident.
  • Publish a case study article in an industry magazine.
  • Train Marsden State High School Year 12 students in safety awareness involving heavy vehicles.
  • Motorbike training for 50 riders (aged 40 and over) – a full-day course to be conducted at the Queensland Transport Mt Cotton Training Centre.

The minimum agreed expenditure (including departmental recoverable costs) is $97,676.
