Incident:
On 6 September 2007, a site visitor to Finlay Screening and Crushing Systems Pty Ltd was struck in the eye by a metal shard that was dislodged when workers struck a metal flange housing on an item of plant with a sledge hammer.

Alleged breach:
s.24(1) and s.28(1) of the Workplace Health and Safety Act 1995
Summary of undertakings:

Activities Finlay Screening and Crushing Systems Pty Ltd will undertake include:

  • implementing an occupational health and safety management system consistent with the requirements of AS/NZS 4801:2001 and auditing of the system no less than three times throughout the life of the undertaking
  • providing a range of specified safety training for managers and workers
  • inspection and auditing of machinery and plant by an external consultant to identify areas for improvement
  • training three additional workers with St John’s Ambulance first aid training
  • re-configuration of the workshop with a new lunch room to provide safer access for workers and members of the public
  • construction of a new paint booth with improved safety measures installed
  • construction of two heavy duty ramps to aid in the loading and unloading of large machinery on site
  • review and implementation of improved fire safety procedures, equipment and training
  • publication of a case study article in an industry journal on lessons learned as a result of the incident, and
  • donation of an agreed amount to Royal Brisbane Hospital Eye Unit for the purchase of medical equipment.

This undertaking has a total minimum expenditure of $90 000 (including recoverable departmental costs).
