Incident:

On 20 July 2007, a driver from R.B Russell Transport Pty Ltd, suffered a fractured left hip and bruising to his left arm and leg when he slipped and fell from his truck whilst unloading roofing products.

Alleged breach:

s.28(1) of the Workplace Health and Safety Act 1995

Summary of undertakings:

Activities R.B. Russell Transport Pty Ltd will undertake include:

  • implementing a formal documented Occupational Health and Safety (OHS) management system that is consistent with the requirements of AS/NZS 4804:2001
  • an initial audit will be undertaken within six months of implementation of the system with provision made for a further two audits at 12 monthly intervals commencing 12 months after the initial audit report has been provided
  • appointing a full time Risk and Compliance Officer and Yard Safety Supervisor
  • training 3 staff members in Certificate IV in Training and Assessment
  • providing specific OHS Committee training to members who do not possess formal OFS qualifications
  • engaging a consultant to deliver a case study presentation and to discuss risk assessments in the heavy vehicle transport industry, and
  • donating an agreed amount to Spinal Cure Australia.


    This undertaking has a total minimum expenditure of $145 000 (including recoverable departmental costs).
