Incident:

On 19 June 2006, a worker suffered injuries when he was struck by a gas bottle dropped from a height at a J&L Schmider Investments Pty Ltd worksite at Gladstone, Queensland.

Alleged breach:

s.24(1) and s.28(1) of the Workplace Health and Safety Act 1995

Summary of undertakings:

Activities J&L Schmider Investments Pty Ltd will undertake include:

  • conducting a series of third party audits of the company occupational health and safety management system against AS/NZS 4801:2001 and implement subsequent audit recommendations
  • installing nine welding fume extraction units within the workshop over three years
  • engaging an external consultant to deliver manual task training to 40 workers and review the suitability of the existing manual task training program
  • publishing an article in a health promotion journal sharing the company’s experience from the incident and raising awareness of the risks involved and preventative measures that could be implemented, and
  • donating an agreed amount to the Mount Isa Ambulance Service.

This undertaking has a total minimum expenditure of $63,000 (including recoverable departmental costs).
