Incident:
On 16 May 2006, a rural worker had his right hand almost completely amputated while clearing a blockage from a Stark Engineering & Hardware Pty Ltd manufactured pineapple harvester. The pineapple harvester was re-energised while the injured worker had his hand in close proximity to a cutting blade.

Alleged breach:
s.24(1) and s.32(1)(a) of the Workplace Health and Safety Act 1995
Summary of undertakings:

Activities Stark Engineering and Hardware Pty Ltd will undertake include:

  • implementing an occupational health and safety management system consistent with the requirements of AS/NZS 4801:2001 and auditing of the system no less than three times throughout the life of the undertaking
  • providing a copy of the audit reports and actions the obligation holder intends taking in addressing the report recommendations to the Executive Director, Workplace Health and Safety Queensland
  • purchasing high visibility clothing for staff
  • establishment of a workplace health and safety committee within the workplace
  • provision of a range of specified health and safety training for managers and staff
  • engaging an external consultant to assess all hazardous plant manufactured by the company to assess areas for improvement
  • engaging an external consultant to develop and deliver seminars at three rural industry trade shows on safe operation of rural plant, and
  • donation of an agreed amount to the Royal Flying Doctor Service and Angel Flight.

This undertaking has a total minimum expenditure of $130 000 (including recoverable departmental costs).
