Summary

Incident description:

A subcontractor re-securing scaffolding to an excavator had to jump to safety when a gust of wind blew an inappropriately secured scaffolding onto power lines.

WHSQ investigation findings:

The defendant subcontracted a scaffolding company to erect and secure a six metre structure to an existing wall. While the scaffolding company had provided specific plans for the scaffolding's staged demolition and removal, workers directed by the defendant had removed ties between the scaffolding and the wall structure which resulted in the scaffold falling.

The scaffolding had been erected in accordance with a site plan and the scaffolding company had provided procedures for the safe removal of the scaffold in stages. However, the cost of removing the scaffolding was a factor behind the defendant's decision not to follow the removal procedures. The defendant admitted that workers who removed the scaffolding ties did not hold scaffolding licences.

Court result:

The defendant was found guilty and was fined $3,500. No conviction was recorded.

Obligation holders must ensure that the dismantling of scaffolding is conducted in accordance with the manufacturer guidelines and the safe removal procedures supplied by the erector. Obligation holders must ensure that a worker who is instructed to conduct scaffolding removal work has been provided with appropriate information, instruction and training of the safe removal procedures and holds the appropriate licence.
