Summary

Incident description:

A worker fell 6 metres when he stepped backwards through an uncovered sky light void whilst helping to replace an asbestos roof. Wire mesh that had previously covered the void that day had been rolled back to allow easier access for workers to clean the roof space.

Investigation findings:

The investigation found that the risk of falls had been inadequately assessed and managed and that neither the corporation or executive officers used control measures outlined in section 215 of the Workplace Health and Safety Regulation 1997 to control the risk of falls posed by the exposed void.

A fall protective cover over the void may have better managed the risk of falling.

The company’s executive officers have undergone occupational health and safety retraining to better manage the health and safety of their workers and selves.

Court result:

The company was fined $41,000 with 12 months to pay.

The executive officers were given an 18-month good behaviour bond and entered into their own recognisance in the amount of $4,500 without surety. No convictions were recorded for any of the three defendants.
