The following information is published to provide industry with an overview of the changes to work health and safety laws.
Current model Work Health and Safety Regulation (WHS Regulation) is limited to registrable plant and registrable plant design and applies to all plant excluding plant that relies on manual power for its operation and is designed to be supported by the hand (e.g. handsaw, spanner, screwdriver).
The WHS Regulation outlines:
There are specific requirements on persons who design, manufacturer, import, supply, install, construct or commission plant or structures.
A PCBU with management or control of plant must manage the risks associated with plant.
A PCBU must ensure maintenance, repair, inspection and testing be carried out by a competent person.
