Fix broken safety rails when reported
A Beenleigh concrete supply company was fined $40,000 after a contractor was injured in July 2006.
Rinker Australia Pty Ltd pleaded guilty in the Beenleigh Industrial Magistrates Court on May 14 2008 to breaching sections 24 and 28(1) of the Workplace Health and Safety Act 1995 (PDF, 766 KB), having failed to ensure the safety of others was not affected by the way it carried out its business.
The court heard the truck driver suffered multiple fractures, crush injuries and minor brain damage after falling more than 2 metres from a gantry stand.
The Workplace Health and Safety Queensland investigation found the safety railing around the stand had been reported as broken six days before the incident.
The court ordered the company to pay investigation, professional and court costs totalling $3,172.40. No conviction was recorded.
As a result of the incident, the company has carried out staff training, as well as an inspection and maintenance schedule of all gantry stands.
