Definition of a designer, and a designers obligations
A designer of plant, machinery and equipment is someone who designs plant, or who alters (or modifies) the design of existing plant.
A designer of plant must ensure that:
- the plant is designed to be safe and without risk to health when used properly
- the design (if given to another entity to develop) is accompanied by information detailing how the plant is to be used to ensure health and safety
These obligations are stated in full in section 32 of the Workplace Health and Safety Act 1995 (PDF, 766 KB).
Practical advice to help designers meet these obligations is provided in meeting the obligations of a designer and are stated in full in Part 1 of the Plant Code of Practice 2005. A designer must do what the code says or adopt and follow another way that gives the same level of protection against the risk the code describes.
Lastly, some plant design must also be registered to ensure it is safe to be used.
