A manufacturer's obligations
A manufacturer of plant must ensure that plant:
- is manufactured to be safe and without risk to health when used properly
- is tested and examined to ensure it has been manufactured to be safe and without risk to health when used properly
- is accompanied by information about the way plant must be used to ensure health and safety.
These obligations are stated in full in section 32A of the Workplace Health and Safety Act 1995 (PDF, 766 KB)
Practical advice to help manufacturers meet these obligations is provided in meeting the obligations of a manufacturer and are stated in full in Part 2 of the Plant Code of Practice 2005. A manufacturer must do what the code says or adopt and follow another way that gives the same level of protection against the risk the code describes.
Lastly, where the manufactured plant is from a registrable plant design, the manufacturer must ensure the certificate number is supplied with the plant manufactured from the design.
