Legislation requirements

Under the Workplace Health and Safety Act 1995 (PDF, 766 KB), a qualified person must be appointed as the workplace health and safety officer for all workplaces where 30 or more workers are normally employed at the workplace. This is a requirement to assist employers in meeting their workplace health and safety obligations.

A person is qualified if they are the holder of a current certificate of authority of appointment as a workplace health and safety officer prescribed under section 57 of the Workplace Health and Safety Regulation 2008 .

To obtain this certificate, a person must satisfactorily complete an approved workplace health and safety officer course conducted by a Registered Training Organisation as required by sections 31 and 32 of the Workplace Health and Safety Regulation 2008.
